Conveyancing is the legal term for buying a house, selling a house, changing the ownership of your house, for instance into joint names and can also include re-mortgaging your house.

When buying or selling a property, you should instruct a solicitor to handle the conveyancing. Buying a property will probably be the largest single investment you make and it is very important that the transfer of ownership of the property is dealt with properly.

The cost of conveyancing depends on the price of the property and whether you are buying or selling. Leasehold property will attract an increased charge to reflect the extra work involved. How long the conveyancing process takes depends on a number of factors including the time taken for the mortgage to be issued and searches returned, the complexity of the transaction, and the state of readiness of other parties to the chain. An average timescale is between 8 and 12 weeks.

Sale of a residential property

  1. Initial paperwork – Once a sale is agreed we will prepare initial paperwork and send this to you.
  2. Formal instruction – You will need to return the various forms and documents and complete identity checks so that we may be formally instructed.
  3. Title documents – We will obtain the title deeds for the property and examine these thoroughly.
  4. Draft contract pack – We will prepare a draft contract pack and submit this to the purchaser’s solicitor.
  5. Responses to enquiries – Once the purchaser has reviewed the documentation, they will raise their enquiries. We will review these enquiries and deal with providing responses. Your input may be required.
  6. Signing of documentation – Once the documentation is agreed we will arrange your signing of the contract and any other documentation in readiness for completion.
  7. Mortgage redemption – We will obtain where necessary a redemption statement for any mortgage affecting the property.
  8. Completion statement – We will provide you with a completion statement.
  9. Exchange of contracts – Once both parties are ready to proceed, a completion date will be agreed and with your instruction we will proceed to formally “exchange” the contract – meaning both parties are legally committed to the transaction.
  10. Completion – On the completion date we will receive the purchase balance from the purchaser. You will need to vacate the property on or before this date. On confirmation of the funds being received any keys will need to be handed over to the purchaser (usually through the estate agent).
  11. Post completion – We will make payment to redeem your Mortgage and pay any estate agent or other invoices that may be applicable. The remaining balance will be transferred to you.

Purchase of a residential property

  4. Enquiries – We will raise any enquiries as may be necessary.
  5. Searches – We will commission the property searches.
  6. Transfer deed – We will draft a transfer deed.
  7. Replies to enquiries – We examine the replies to enquiries provided by the seller and raise any additional enquiries as may be necessary.
  8. Advice – We will throughout the process provide advice to you. However, we would seek to meet with you to advise in detail on the legal title, the conditions of any mortgage offer and all other matters concerning your purchase.
  9. Signing of documentation – Once the documentation is agreed we will arrange your signing of the contract and any other documentation in readiness for completion.
  10. Exchange of contracts – Once both parties are ready to proceed, a completion date will be agreed and with your instruction we will proceed to formally “exchange” the contract – meaning both parties are legally committed to the transaction.
  11. Completion statement – We will provide you with a completion statement.
  12. Mortgage funds – We will apply for your mortgage funds if required.
  13. Help to Buy ISA / Lifetime ISA – We will apply for funds if required.
  14. Completion – On the completion date we will pay the completion balance to the seller’s solicitor. Once the seller’s solicitor confirms receipt the keys will be “released” and be available for your collection (usually through the estate agent).
  15. Post completion – We will receive the seller’s signed transfer deed. If required we will submit and Stamp Duty Land Tax Return and make payment. We will submit our application to the Land Registry to register you as the owner of the property. Once registration has been completed, we will provide you will the various title deeds and documents confirming your ownership.
